Teen Talaq Bill passed in Lok Sabha

In the Lok Sabha, on July 25, 2019, the ' Teen Talaq Bill ' has been passed by voice vote. Prior to voting, the main opposition party on the bill had a walkout from the House. Union Law Minister Ravi Shankar Prasad said that on minor matters today women are divorced.

In bill, it is termed as Crime to say Talaq three times together. There is also provision for the conviction of the imprisonment to convict in this crime. Many opposition parties have strongly opposed it. In this protest the government has said that this bill is an important step towards gender equality and justice.

 Highlights of  Bill

  •  This bill provides for the provision of teen talaq to be cognizable offense i.e. police officer can arrest without warrant.
  • In this bill, it's to make teen talaq i.e.Talaq-E-Biddat cancelled and unlawful.
  • There is a provision of punishment for up to three years on divorce.
  • Victim woman can keep minor children with her. The magistrate will decide about it.
  • The provision of punishment will be done only when either the woman herself complains or its relative is concerned.
  • Under this bill the magistrate can bail the accused.
  • The bail will be granted by the magistrate only when the favor of the victim woman is heard and the magistrate feels that the basis of bail.
  • The magistrate can permit compromise on the request of the victim woman.
  • Under the bill, the victim woman can claim an allowance by her husband.
  • The amount of the allowance will be decided by the magistrate.

The Modi government had introduced this bill in its second term in May 2019. Several Opposition parties objected strongly to this. The Government has an adequate number in the Lok Sabha to pass this bill but it will not be easy to get it passed from the Rajya Sabha.
