BILKIS BANO CASE: Supreme Court gives government order for Rs 50 lakh

On 23rd April, 2019, the Supreme Court has directed the Gujarat Government to pay compensation of 50 lakh rupees, government jobs and housing for the Bano. During the Gujarat riots in 2002, Bilkis Bano was a victim of gang rape.

The Gujarat government informed the bench chaired by Chief Justice Ranjan Gogoi that action has been taken against the police officials who missed the case. Their pension benefits have been discontinued and the IPS officer who has been convicted by the Bombay High Court has been given two ranks.

The Gujarat government had proposed to pay Rs 5 lakh as compensation to Bilkis Bano, which he had turned down. He had demanded exemplary compensation from the state government in a petition before the Supreme Court. In the Supreme Court, the bench of CJI Ranjan Gogoi, Justice Deepak Gupta and Sanjeev Khanna raised the compensation amount 10 times.

CBI has convicted 18 people in the charge sheet:

  • The CBI found 18 people guilty in the charge sheet. It included two doctors, including five policemen, who were accused of molesting evidence to help the accused.

Supreme Court's decision:

  • The Supreme Court has ordered the state government to immediately impose the punishment on them after the departmental proceedings against the policemen found guilty of mis-investigation in the case.
  • The court told the Gujarat government that according to the rules, there was a compensation of Rs 50 lakhs, a government job and housing to Bilkis Bano.
  • The court had directed the Gujarat government to complete the disciplinary action within two weeks against the police officers convicted in the Bilkis Bano case.

What was the case?

  • After the Godhra carnage on 27th February, communal riots broke out in entire Gujarat. This massacre took place at large scale. A few days later, on March 3, 2002, a mob attacked the family of Balkis Bano in Randhir Pur village near Ahmedabad.
  • In this attack, 14 people of his family, including two year old daughter of Bilkis, were killed. There was mass gang rape with Bilkis. At that time she was 5 months pregnant.
  • The initial investigation of the Bilkis Bano case started in Ahmedabad. The CBI filed its charge sheet on April 19, 2004. After this, BilKis Bano had expressed the apprehension that the witnesses could be harmed and CBI evidence could be tampered with.
  • The Supreme Court had transferred the case to Bombay on August 6, 2004 on the demand of the Bilkis. The special court had convicted 11 people in connection with gangrape of gang rape and murder of his family members in his decision on January 21, 2008.
