Bihar' s 3.5 appointed teachers will not get equal salaries

The Supreme Court has canceled the salary related decision of about 3.5 lakh employed teachers in Bihar on May 10, 2019. While granting the Bihar government's appeal, the Supreme Court canceled the decision of the Patna High Court.

In this case, the appeal of the Bihar government has been approved by the Supreme Court. In the case of Bihar's nearly 3.5 lakh employed teachers, the Supreme Court has issued an important decision. The decision was made by a bench of Justice Abhay Manohar Sapre and Justice Uday Umesh Lalit.

Bihar Government Appealed in Supreme Court:

  • On behalf of the Bihar government, a special permission petition was filed in the Supreme Court.
  • In that petition, it was said that employed teachers are employed under Panchayati Raj bodies and not employees of Bihar government, so they cannot be given equal salary for government teachers.
  • The teachers employed by the Patna High Court were ordered to pay the salary equal to regular government teachers.
  • The Bihar government had appealed this order to the Supreme Court and demanded an immediate ban on the order.

Patna High Court Verdict

  • The teachers employed by the Patna High Court were ordered to pay the salary equal to regular government teachers.
  • The High Court had ruled in favor of teachers and ordered the Bihar government to pay equal pay.
  • The Bihar government filed a petition in the Supreme Court against the High Court decision.
  • In the Supreme Court, 11 petitions were heard on this matter, after which the court had reserved the verdict on October 3, 2018.
  • Employed teachers have long been agitating for the demand of equal pay for equal work in Bihar.

  • It is argued in the Court on behalf of the Teacher Union that equal pay should be given for equal work and this fundamental right of employed teachers is given.
  • Reinstituition of Teachers by Panchayati Raj Institution:
  • The central government did not agree to increase the amount to pay equal pay to employed teachers.
  • Attorney General K.K. in the Supreme Court,  Venugopal had said that the appointment and salary of teachers is the work of the state government.
  • There is no role of central government in this.
  • The central government had said that regular teachers were restored by the Bihar Public Service Commission (BPSC).
  • At the same time the restoration of the appointed teachers has been done on the contract from Panchayati Raj Institutions, so the employed teachers can not be given equal pay.

  • About 3.5 lakh employed teachers are working in Bihar.
  • The state government gives 70 percent of the salary of the teachers and 30 percent of the money to the central government.
  • The Bihar government had said that it is not financially able to pay teachers to the teachers.
  • The government can increase teachers' salaries by only 20 percent.
  • The Patna High Court had ruled in favor of employed teachers on 31 October 2017 on the issue of low pay.
  • Later, the Bihar government had challenged the High Court's decision on December 15, 2017 in the Supreme Court.
